If the black and white logo is registered. Is my IP protected in color?

Here is a short Q&A for a question that gets asked sometimes regarding IP registration for logos.

At this stage we are interested in registering the attached logo, as we are already pushing through a PCT application that will buy us a couple of years extra time. As the black and white logo is registered, I presume the trademark protection will cover its use in any color?

  • Yes, but it's better to check the application date of the patent, so you will know for sure when the PCT will expire.
  • Yes, correct. In China, protection will cover its use in any color when the black and white logo is registered.
